1.WITHDRAWAL POLICY FOR CONSUMERS

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods. To exercise your right of withdrawal, you must inform us, Mallorca Collection GbR, Adlerstr. 7, 84051 Essenbach, phone: +49 (0) 8703 905866,

e-mail: service@mallorcacollection.eu, of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the following model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of revocation

 

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us, Mallorca Collection GbR, Adlerstr. 7, 84051 Essenbach, without delay and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

End of the withdrawal policy

The right of withdrawal does not exist in accordance with § 312g para. 2 BGB for the delivery of goods that are manufactured according to customer specifications or are clearly tailored to your personal needs, for the delivery of audio or video recordings or software, if the delivered data carriers have been unsealed by you or for sealed goods that are not suitable for return for reasons of health protection or hygiene and whose seal or hygiene strips have been removed after delivery.

2. STORAGE OF THE CONTRACT TEXT WHEN ORDERING ON THE INTERNET

 

 

The text of the contract is not stored by us and can no longer be retrieved after the order process has been completed. However, you can print out the order data immediately after submitting it. Furthermore, you will receive an order confirmation with all order data (without our GTC) by e-mail if you have provided a correct e-mail address. This requires the technical availability of your e-mail inbox.

 

3. PRICES, SHIPPING COSTS

 

 

The prices quoted include the applicable statutory VAT. The prices valid at the time of ordering apply. Regardless of the order value, the shipping costs are a one-off charge of €5.95 for delivery in Germany and €8.95 for delivery to other European countries. Please note any references to higher shipping costs in the product descriptions of 

4. DELIVERY 

 

 

Mallorca Collection delivers with the optimal means of transportation. We usually ship your goods with DHL. The delivery time is three to five days. We will inform you immediately in the event of unexpected delays in delivery. Despite careful stocking, it may happen that an item is sold out sooner than expected. We therefore do not guarantee delivery. The following applies: Only while stocks last. If the ordered product is not available because we are not supplied with this product by our suppliers through no fault of our own, we can withdraw from the contract. In this case, we will inform you immediately and, if necessary, suggest the delivery of a product of equivalent price and quality. If no comparable product is available or if you do not wish to receive a comparable product, we will immediately reimburse you for any payments already made. If goods are delivered with obvious transport damage, please complain about such defects immediately to the deliverer and contact us as soon as possible (free of charge at service@mallorcacollection.eu). Failure to make a complaint or contact us has no consequences for your statutory warranty rights. However, you will help us to be able to assert our own claims against the carrier or the transport insurance company and to be able to deliver to you without any problems in the future. Extra tip: Gift service and service for working people! Order and delivery address do not have to be the same. We deliver to any address (except a PO box address) in Germany (simply enter this in the order form). This is ideal if you want to give someone a present or are difficult to reach at home.

5. WARRANTY / LIABILITY / EXCHANGE

 

Guarantee 

The statutory liability for defects applies. If we also grant you a dealer's warranty, the details can be found in the warranty conditions enclosed with the item supplied. Warranty claims exist independently of warranty rights.

Liability 

Subject to the above provisions, Mallorca Collection's contractual and statutory liability for damages is limited as follows:

Mallorca Collection's liability shall be limited to the amount of damages typically foreseeable at the time of conclusion of the contract for the slightly negligent breach of a material contractual obligation (i.e. such contractual obligations whose fulfillment is essential for the proper execution of the contract, whose breach jeopardizes the achievement of the purpose of the contract and on whose compliance the customer regularly relies, "cardinal obligations"); 

Mallorca Collection is not liable for the slightly negligent breach of non-essential obligations arising from the contractual obligation. The aforementioned limitation of liability shall not apply to cases of mandatory statutory liability, in particular not to liability under the Product Liability Act, liability for damages caused by intentional or grossly negligent behavior, or liability for death or personal injury of any kind. Furthermore, those limitations of liability shall not apply if and insofar as Mallorca Collection has assumed a specific guarantee. Insofar as the liability of Mallorca Collection is limited or excluded, this also applies to the personal liability of its legal representatives, employees and vicarious agents. 

Exchange

We do not offer exchanges of items. If you wish to purchase a new item, please place a new order via www.mallorcacollection.eu.

 

6. PAYMENT OPTIONS


Payment can be made by credit card or paypal. 

Purchase by credit card 

Your card account will be debited with the invoice amount when the invoice is issued. Please note that credit card payment is only possible on the Internet!We accept Visa and Mastercard.

Purchase via PayPal

When purchasing via PayPal, the amount will be debited to your PayPal account immediately after receipt of the order.

Default of payment
If you get into payment difficulties, please contact our customer service immediately to avoid additional costs for you. If you do not meet your payment obligation on time, we will charge €2 for the first reminder, €6 for each subsequent reminder and €9 for the last reminder, whereby you are at liberty to prove that no or only minor damage has been incurred.Our statutory claim to payment of interest on arrears remains unaffected, as do any claims to further costs arising from any necessary debt collection proceedings.

Treatment of vouchers

Please note that vouchers may be subject to time and/or quantity restrictions. We will clearly point out such restrictions in the text accompanying the voucher. Only one voucher can be redeemed per person and order. The voucher cannot be used for reduced items. Vouchers issued by us will not be paid out in cash or transferred. Even in the case of an order for which a voucher has been credited against the purchase price and for which one or all items have been returned, the customer is not entitled to a cash payment or transfer of the corresponding voucher value. Rather, in this case only the amount actually paid by the customer will be refunded, the voucher value will be retained and can be used again for a next order, provided the voucher is still valid at the time of ordering. In this case, too, only one voucher can be redeemed per order.

Invoicing

Your credit card or other means of payment will be charged when your order is ready for delivery.
When we confirm by email that your item has been dispatched, you will receive an electronic invoice attached to your order. We do not issue paper invoices.

 

7. RETENTION OF TITLE

The goods remain the property of Mallorca Collection until full payment has been received. 

 

8. DATA PROTECTION

 

 

The provisions of our privacy policy apply to data protection.

 

9. DISPUTE RESOLUTION PROCEDURE

 

 

We endeavor to settle disputes arising from our contractual relationship in an amicable manner. Therefore, please contact our customer service. If you do not agree with the solution found there and the amount in dispute is up to a maximum of € 500, you can contact the following state-recognized consumer arbitration board to carry out a mediation procedure free of charge for you: Allgemeine Verbraucherschlichtungsstelle (at the Zentrum für Schlichtung e.V.), Straßburger Straße 8, 77694 Kehl. www.verbraucher-schlichter.de.

If no agreement can be reached there, you can take legal action.

Alternatively, you can also use the dispute resolution platform provided by the European Commission for online dispute resolution. (links are available at bmjv.de/odr-banner) 

 

 

10. FINAL PROVISIONS

 

 

These GTC are subject exclusively to German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). Any disputes arising in relation to or in connection with these GTC (including non-contractual disputes) shall be subject to the non-exclusive jurisdiction of the German courts, provided that this does not affect the right of either party to bring an action before another competent court in accordance with applicable procedural law. If you do not have a general place of jurisdiction in Germany or move your place of residence abroad after conclusion of the contract or your place of residence is not known at the time the action is filed, the place of jurisdiction for all disputes shall be the local or regional court in Landshut responsible for the registered office of our company.
